CABLENET.ME SERVICE – TERMS & CONDITIONS

1. DESCRIPTION OF THE SERVICE

Cablenet.me Service (“the Service”) provides the opportunity to all Cablenet Communication Systems Ltd (“Cablenet”) subscribers to manage their accounts electronically through the Internet for most of the services provided to them by Cablenet.

The service is offered only to Cablenet Subscribers and its use is subject to these Terms of Use. Please note that by making use of the Service you are agreeing to comply and be bound by the following terms and conditions.

2. ACCESS TO THE SERVICE

2.1 The Subscriber gains access to the Service through the use of a username and a password provided by Cablenet. Upon submission of an application for access to the Service through the Cablenet website the Subscriber receives a password electronically. The Subscriber is exclusively responsible for keeping this password confidential and will be solely liable for any activities carried out with the use of this password. The password is personal, non-transferable and non-negotiable.

2.2 In the event of unauthorized use, loss or theft of the password, the Subscriber should inform Cablenet immediately.

3. CONFIDENTIALITY

3.1 Subscribers shall be called upon to register by completing a relevant application electronically. In such a case, they shall be requested to provide information such as name, customer number, ID number, electronic mail address and contact telephone number. Subscribers have the obligation to provide true, reliable, up-to-date and complete information about themselves.

If Cablenet has well-founded suspicions that the information provided is false, inaccurate, not recent or incomplete, it shall have the right to deny or terminate access to the Subscriber in question, without any prior notice.

3.2 Cablenet shall take all necessary measures to protect Subscribers’ confidentiality. All information and data provided upon registration shall be protected and shall not be transferred to third parties without the Subscribers’ consent, except as provided in paragraph 3.3. Data revealing identity, such as name, address, email address, phone number or other information shall not be revealed or transferred by Cablenet to third parties without the Subscribers’ consent.

3.3 Cablenet may reveal information and data provided by the Subscriber in the circumstances provided for by law and with the permission and/or order of the Court, where this is required.

3.4 The Subscriber declares that he/she is aware that the Company maintains a record of personal data and he/she expressly consents to the processing of personal data concerning himself for purposes relevant to the use of the Service or for any other purpose in accordance with the provisions of his/her agreement with Cablenet for the provision of electronic services.

3.5 The Subscriber expressly consents that any information and data concerning himself, which he/she provides or which is collected by Cablenet in the process of using the Service, be held, used and processed by Cablenet in accordance with the provisions of the agreement between them for the provision of electronic services.

4. DISCLAIMER

4.1 Cablenet (including its officials, associates and employees) will not, under any circumstances, be liable to a Subscriber or a third party for any direct, indirect, exemplary, punitive, incidental, special or consequential damages, including but not limited to any damage for loss of income or loss of reputation, or any other damages arising from or related to :

(a) The use of, or the inability to use the Service.
(b) Any products, data, information or services obtained or accessed through the Service.
(c) Unauthorized access to data or amendment of data.
(d) Demands associated with the use of software.
(e) Breach of any rights of any person of any nature, which occurs or is being attempted through the Service.
(f) Interruption of service or disconnection of Subscribers.

4.2 Cablenet shall not be responsible for any access to the Service as a result of using a Subscriber’s password without prior authorization or following the loss or theft of a Subscriber’s password.

4.3 Cablenet shall not be responsible in any way for any damage or loss of any kind, which may be caused by transferring data from the Service or accessing the Service contents.

4.4 Cablenet does not make or give, nor is it implied that it has made or given, and hereby disclaims, any representations, guarantees or warranties, express or implied, of any kind, including, without limitation, warranties of merchantability, of quality and of fitness for a particular purpose or guarantees for continuous, uninterrupted, on-time, secure and infallible provision of the Service and does not warrant that the Service will be available at any time or place.

4.5 Cablenet is not responsible for any defamation in connection with a person or products or services or for any infringement of copyright or for contempt of Court or for any infringement of any person’s privacy or for breach of contract or for committing a civil wrong or for any other wrong, violation or offence committed or attempted by any person through the Service.

5. TERMINATION OF THE SERVICE

5.1 Cablenet reserves the right to:

(a) interrupt, upgrade, amend, temporarily or permanently suspend the Service or the Subscriber’s account (including the password), bar, refuse or stop the use or access to the Service at any time without notice.

(b)Amend the present Terms of Use of the Service.

6. INTELLECTUAL PROPERTY RIGHTS

6.1 The Service and the Service software contain material and information, including without limitation its design, look, layout and graphics which is owned by or licensed to Cablenet and is protected by the legislation on copyright, trademarks, service marks, patents or other intellectual property rights.

6.2 Subscribers may not copy, download, reproduce, distribute, republish or make in any way available the contents of the Service, or create products derived from the contents of the Service, without the prior express written authorization of Cablenet.

7. USE OF THE SERVICE

A Subscriber who makes use of the Service shall act lawfully and in accordance with good and ethical commercial practice and shall comply with all the relevant laws and regulations and decisions of competent authorities. A Subscriber is prohibited from using the Service in a way which is immoral, illegal, offensive, or which may cause problems to Cablenet or to other users.

The Subscriber shall indemnify Cablenet for any loss or damage it may suffer and for any amount of money, including, without limitation, any legal fees for contesting any claim or otherwise, which it may be obliged to pay to any person as a result of any act or omission of the Subscriber relating to or arising from the use of the Service.

8. ELECTRONIC PAYMENTS

Any payments made through the Cablenet.me service will appear as purchases with the name ‘Cablenet Services’ in your bank statement.

9. BREACH OF TERMS OF USE

If a Subscriber breaches any of these Terms and Conditions or any of the terms of this agreement with Cablenet for the provision of electronic services, Cablenet shall have the right to suspend or terminate the Subscriber’s access to the Service without notice. Furthermore in the event of breach of these Terms and Conditions Cablenet shall be entitled to claim damages and/or to take any other action it considers appropriate against the Subscriber to protect its rights and safeguard its interests.

10. AMENDMENT OF TERMS OF USE

Cablenet may at any time amend the present Terms and Conditions for the provision of the Service. By continuing to use the Service the Subscriber agrees to be bound by any such amendments.

11. GOVERNING LAWS

The use of the Service and any dispute arising out of such use is subject to the Laws of the Republic of Cyprus.
